§ 9-72-3. Admission requirements.

    No proprietor or provider of personal care home services for adults shall allow any person to become a resident unless such person provides a certificate from a licensed physician. This certificate or form shall be provided by the health department and completed by a licensed physician before a person can enter as a resident in a personal care home. The health department is not required to provide the physician, but will provide assistance and direction to those seeking admission. Persons who are not independently mobile shall not be admitted to a personal care home. Any proposed resident referred by a mental health institution, mental health center, or a mental health facility for retarded individuals, or any agency responsible for rehabilitating persons involved in alcohol or drug abuse, must furnish a written assessment of his or her needs from that institution or agency, or qualified licensed clinical psychologist or psychiatrist before admission to a personal care home.

    In cases of emergency admission, five working days from date of emergency admission will be allowed for acquisition of the certificate. Persons with levine tubes, gastronomy tubes, intravenous tubes, indwelling catheters, and persons with tracheotomies are specifically excluded from emergency admissions. "Emergency admission," as used herein, means whenever the state Department of Human Services is securing care for an ambulatory or independently mobile person within a 24-hour period when normal processing cannot be provided, as in the case of periods of extreme hot or cold weather, or destitution.
