§ 9-72-4. Staffing.
A.
The provider must be physically and mentally capable of providing needed services to the residents. Homes with nine or less residents shall require at least one staff person who is capable and responsive, to be physically present and available. Other staff shall be retained, as necessary, for laundry, food service, housekeeping, and maintenance requirements.
B.
In homes with ten or more residents, the provider and/or staff shall be present in numbers to provide a minimum of 45 minutes of individual care service per day per resident, to all residents requiring these services.
