§ 9-72-11. Agency coordination.
The health department shall coordinate the administration of this chapter between itself and the fire services division, the bureau of construction code enforcement and the city and county office of planning and development and each shall be assigned special duties as follows:
A.
Health department. The health department shall:

Make inspections at least quarterly to ascertain the sanitation level of the kitchen, the sanitation level of the residents' rooms, general health of the residents, and general compliance with this chapter. The results of this inspection shall be made available to the provider on forms provided by the health department;
2.
Have the responsibility for notifying and confirming annual fire and building inspections, and be responsible for the coordination of plan review and approval, management of complaints and referrals, and the coordination of all required annual inspections, the institution of timely legal action, and the training of providers and staff who manage and operate personal care homes as provided in this chapter;
3.
Coordinate its inspections with the department of public health, the state Department of Human Services, and the state Department of Mental Health and Mental Retardation, where applicable and appropriate.
B.
Division of fire services. The division of fire services shall make inspections as necessary to assure fire safety codes are being enforced. An inspection of all personal care homes shall be made it least one time per year. The health department may request additional inspections with probable cause such as complaints or an observed hazard.
C.
City and county office of planning and development. The city and county office of planning and development will review and process applications for zoning amendments in accordance with sections 6, 8, 9 or 14 of the Joint Ordinance/Resolution No. 3064, as amended, for residential homes for the aged, rooming houses, boarding homes, or group shelters which may be called personal care homes.
D.
Bureau of construction code enforcement. The bureau of construction code enforcement will enforce zoning, electrical, plumbing and structural codes, as may be applicable by the provisions therein, including Joint Ordinance/Resolution No. 3064, section (9)(D)(2), paragraphs 1 and 2. New building, mechanical, and plumbing construction or remodeling of personal care homes shall have plans reviewed and approved by each appropriate department. Owners failing to obtain necessary approval from all departments shall be held liable and subject to citation, whether work had been started or completed.
