§ 9-76-9. Location of wells in street, alley or public place.
A.
No well shall be located in a street, alley or public place out a permit from the city council.
B.
Any person making application for a permit to construct a well in any street, alley, or other public place shall be required, as a condition precedent to the issuance of such permit, to agree that if at any time subsequent to the construction of such well it shall become necessary for the city to use such street, alley, or other public place, for any public purpose, such person shall, within 90 days after the receipt of notice from the city, abandon, dismantle, and fill such well, at his or her own expense.
