§ 10-8-12. Nudity and sexual activities in public places.
A.
It is unlawful for any person to perform in a public place, or for any person who owns or operates premises constituting a public place to knowingly permit or allow to be performed therein, any of the following acts or conduct:
1.
The performance of acts or simulated acts of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation, or any sexual acts which are prohibited by laws, including but not limited to the actual or simulated touching, caressing or fondling of the breasts, buttocks, anus or genitals in public; or
2.
The actual or simulated public displaying of the pubic hair, anus, vulva or genitals.
B.
With the exception of nursing mothers feeding their babies, it is unlawful for any live female to appear in a public place so costumed or dressed that one or both breasts are wholly or substantially exposed to public view, and it is unlawful for an owner or operator of premises constituting a public place to permit or allow any such person to appear on the premises owned or operated by him or her. "Wholly or substantially exposed to public view," as it pertains to breasts, means the showing of the female breast, in a public place, with less than a fully opaque covering of any portion of the areola, or with a covering simulating the areola.
C.
For the purpose of this section, "public place" includes: streets, sidewalks or highways; transportation facilities; schools; places of amusement; parks; playgrounds; restaurants; nightclubs; cocktail lounges; burlesque houses; bars; cabarets; taverns; taprooms; private fraternal, social, golf or country clubs; or any public place that allows the consumption of intoxicating beverages on the premises.
D.
Any person violating any of the provisions of this section shall be subject to all penal provisions provided by law, and the maximum fine provided by law.
E.
Any violation of this section shall be a public nuisance and shall be subject to abatement by injunction.
