§ 9-96-4. Notice to property owner to cut and clean.

  • A.

    Upon the failure of any owner of property within the city to cut, or have cut, weeds, rank grass or noxious growths, it shall be the duty of the grounds maintenance section of the general services division to serve a notice on the owner of such property to cut or to have cut, within five days of the service of such notice, all weeds, grass, or noxious growth upon his or her property. Such notice: (1) may be served personally on the owner of the property; (2) may be mailed to the last known address of such owner by registered or certified mail; or (3) may be posted on the property on which such weeds, grass or noxious growths exist.

    Service of notice by any of the above methods shall be due notice to such owner.

    Service of notice under the provisions of subsection A of this section, shall be required of the city only one time during a growth season and shall be deemed to be sufficient, satisfactory and legal notice to the property owner for any further violations during the balance of that growth season.

    2.

    "Growth season" is defined to be that period of time between May 1 and September 30 of each calendar year.

    D.

    Should the owner or responsible tenant in charge fail to cut and clean the property following notice as set out above, city forces under supervision of director of general services reserves the right to enter the premises for the purpose of removing abandoned tangible personalty, weeds, rank grass and noxious growths to prevent hazard conditions, nuisances, and urban blight.
