§ 9-76-19. Installation of individual water meters on newly constructed residential rental units.

    Definitions . For purposes of this section, the following definitions shall apply:

    Apartment means a residential rental unit consisting of one or more rooms with a private bath and kitchen facilities comprising an independent, self-contained residential unit in a building.

    Apartment complex means two or more apartments in one or more buildings that are owned by the same owner, located on the same lot or tract, and managed by the same owner, agent or management company.

    Condominium means the ownership of single units in a multiple unit structure or structures with common elements.

    Master meter means a utility owned meter that measures and totalizes the volume of water flowing from the water distribution system into an apartment complex or newly constructed condominium.

    Newly constructed condominium means:

    1.

    Any structure for which a building permit for construction of a condominium is issued on or after July 1, 2014; or

    2.

    Any existing apartment that is converted into a condominium on or after July 1, 2014.

    B.

    The developer or condominium owner shall provide for individually metered water service to each unit in a newly constructed condominium. A master meter shall not satisfy the requirement in this subsection (B).

    C.

    If the owner of an apartment complex fails to pay any water bill issued to the owner by MLGW, then MLGW shall notify the local code enforcement entity of the impending cut-off simultaneously with the issuance of the utility's notice of cut-off to the apartment owner.

    D.

    Upon receipt of notification as provided in subsection (C) above, the local code enforcement agency shall inspect the property and take such additional action as may be permitted by federal, state and local law.
