§ 9-56-8. Location of containers; safe premises for collection.

  • A.

    Carts shall be placed on the neutral strip immediately adjacent to the curb or, in the absence of a neutral strip, immediately adjacent to and just behind the sidewalk, if possible. If, because of a retaining wall or other impediment, carts must be placed on the sidewalk, they shall be placed immediately adjacent to the curb in such a manner that pedestrian traffic on such sidewalk is minimally obstructed. In the absence of curbs, carts shall be placed immediately adjacent to the surfaced roadbed. Where alley collection is provided, carts shall be placed immediately adjacent to the rear property line in such a manner so as to provide open access from the alley. Nothing is to be placed in the alley right-of-way.

    B.

    Where exempted from cart participation, it shall be incumbent upon tenants, lessees, occupants or owners of premises to provide a safe and convenient entrance to and through the premises when required for the purpose of collecting solid waste. Where alley collection is provided, individual can-type containers shall be placed at a convenient and accessible point in the yard within five feet of the alley. In the absence of alley service, can-type containers shall be placed at a convenient and accessible point adjacent to a drive or walkway. Where yards are fenced, a gate suitable for passage of collectors and equipment and a minimum of 40 inches in width shall be left open to provide a safe and convenient entrance to and through the premises. Containers shall be placed where collectors may service them without attack from animals.

    C.

    City collectors shall not enter any structure for the collection of solid waste nor shall they accept any money or valuable gifts from persons served.

    D.

    Solid waste shall not be stored in close proximity to other personal effects which are not desired to be collected, but shall be reasonably separated in order that the collectors can clearly distinguish between what is to be collected and what is not.

    E.

    The director may, by regulation, provide for the location of all solid waste containers.
