§ 9-52-2. Approval of plans for construction and alteration of food service establishment.

  • Whenever a non-temporary food service establishment is constructed or extensively remodeled and whenever an existing structure is converted to use as a food service establishment, at least one set of properly prepared plans and specifications for such construction, remodeling, or conversion shall be submitted to the health department for review and approval at least 15 days before construction, remodeling, or conversion is begun. The plans and specifications shall indicate the proposed menu, layout, arrangement, mechanical plans, and construction materials of work areas, as well as the type and model of proposed fixed equipment and facilities.

    After the plans and specifications have been approved by the health department, the food service establishment shall not start operations until a preoperational inspection has determined compliance with the approved plans and specifications and the requirements of this article and the TDH/TDA Rules and Regulations as referenced below.
