§ 9-12-42. Penalty provisions.

  • Failure to pay the fees set forth in this chapter shall be a violation of the Memphis/Shelby County air pollution code and can result in the assessment of penalties and injunction against the stationary air pollution source. In addition to any fee owed, a maximum penalty equal to 50 percent of the fees owed may be assessed for late payment. Interest in the amount equal to the maximum allowed under state law shall also be charged for all fees paid more than 30 days late. When an emissions fee amount is contested, only the contested portion can be withheld. Any uncontested fee amount must be paid by the due date for payment. Due process for contested amounts is provided by appeal under the administrative and judicial review provisions of the Memphis/Shelby County air pollution code for appeal of decisions of the director.
