§ 5-4-3. Payments into general fund—City publication costs.

    A fee or rate may be charged to cover city publication cost on items such as, but not limited to, notices, ordinances, resolutions and/or notice to bidders, which require official action by either the administrative or legislative branch of government; provided, the official action is being made at the request of any individual, and the benefits therefrom inures to the particular interest or benefit of such individual. All such fees or rates shall paid into the general fund of the city to be disbursed to the specific division or account it will affect. A determination of the amount of fee or rates to be paid shall be within the discretion of the city comptroller, calculated upon an estimated cost of such publication based on the then current consumer prices. This section does not apply to other sections of this Code wherein such a fee or rate has been established.

    B.

    Such fee or rate so collected shall not be refunded upon the failure of either the administrative or the legislative branch of government to approve the individual's requested action.
