The city reserves the right, at any time and from time to time, to modify or amend,
in whole or in part, any or all of the provisions of this title, without the consent
of any participant, spouse, child, or any other person or persons claiming through
them, by action of the council, including specifically the right to modify the title
into a supplementary retirement plan, if the Federal Social Security System is amended
to require Social Security coverage of participants, and to make any such modifications
or amendments effective retroactively, if necessary; provided, that no such notification
or amendment shall reduce the nonforfeitable interest of any participant or make it
possible for any part of the assets of this retirement system to be used for or diverted
to purposes other than the exclusive benefit of participants and their spouses and
children under this title, prior to the satisfaction of all liabilities with respect
to such participants, spouses and children, except as indicated in section 4-24-9 or 4-28-9.
