§ 2-26-1. Created and established.
A.
There is created and established a division of park services, which shall henceforth have complete and full control and management over all parks, playgrounds, recreational areas or centers, park or recreational facilities, parkways, boulevards, devices, concessions or any properties, projects, budgets or operations now or at any time devoted to or designated for use or used for park purposes or as part of the park system within the city.
B.
The Memphis Park Commission's jurisdiction and control over all parks, playgrounds, recreational areas or centers, park or recreational facilities, parkways, boulevards, devices, concessions or any properties, projects, budgets or operations now devoted to or designated for use or used for park purposes or as part of the park system is rescinded and such jurisdiction, control and authority shall be transferred to and shall be vested in the division of park services. All existing properties, budgets, personnel and operations are transferred from the former Memphis Park Commission to the division of park services as of the effective date of Ordinance No. 4763.
C.
The management and operations of the division of park services shall be under the supervision of a director of such division, who shall be appointed and removed in the same manner as other division directors of the city. The director of the division of park services shall report to, take direction from, and be responsible to the mayor for the efficient, economical and professional administration of the division of park services.
D.
Notwithstanding anything in this chapter to the contrary; however, no land, building, or facility under the jurisdiction of the mayor and/or division of park services shall be demolished, sold, given to, dropped from funding, closed to services or leased to any non-municipal entity (excluding routine short-term rentals of two years or less) without prior authorization of the city council, nor shall the mayor enter into a use of facility agreement, partnership agreement or operating agreement regarding any such land, building or facility under the jurisdiction of the mayor without prior authorization of the city council.
