§ 1-4-6. Ordinances not affected by adoption of Code.

  • The repeal provided for in the ordinance adopting this Code shall not affect any of the following:

    A.

    Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of the ordinance adopting this Code;

    B.

    Any ordinance or resolution promising or guaranteeing the payment of money for the city, or authorizing the issuance of any bonds of the city or any evidence of the city's indebtedness, or any contract or obligations assumed by the city;

    C.

    The administrative ordinances or resolutions of the city not in conflict or inconsistent with the provisions of this Code;

    D.

    Any ordinance or resolution fixing salaries or compensation of officers or employees of the city, or establishing the personnel policies and procedures;

    E.

    Any appropriation ordinance or resolution;

    F.

    Any right or franchise granted by the council to any person, firm or corporation;

    G.

    Any ordinance or resolution dedicating, naming, establishing, locating, relocating, opening, closing, paving, widening, vacating, etc., any street or public way in the city;

    H.

    Any ordinance or resolution establishing and prescribing the street grades of any streets in the city;

    I.

    Any ordinance or resolution providing for local improvements or assessing taxes therefor;

    J.

    Any ordinance establishing fees, rates and charges, not inconsistent with this Code;

    K.

    Any ordinance annexing property to the city;

    L.

    Any zoning ordinance of the city or amendments thereto;

    M.

    Any ordinance authorizing formation of joint agencies with other governments;

    N.

    Ordinances or resolutions prescribing traffic regulations for specific locations, prescribing through streets, parking limitations, parking prohibitions, one-way traffic, limitations on loads of vehicles or loading zones, speed limits and other specific traffic regulations, not inconsistent with this Code;

    O.

    Any ordinance levying taxes;

    P.

    Any ordinance relating to boiler, compressor, refrigeration equipment, etc., installers and operators;

    Q.

    Any ordinance adopting a building code or amending the same;

    R.

    Any ordinance adopting an electric code or amending the same;

    S.

    Any ordinance providing gas fitting regulations;

    T.

    Any ordinance providing plumbing regulations;

    U.

    Any ordinance adopting a fire safety code or amending the same;

    V.

    Any subdivision ordinance or amendments thereto;

    W.

    Any ordinance enacted after September 4, 1984; nor shall such repeal be construed to revive any ordinance or part of an ordinance that has been repealed by a subsequent ordinance which is repealed by the ordinance adopting this Code.
